A San Francisco-based software company has changed its non profit discount policy following a religious discrimination lawsuit filed by a Christian organisation.
Holy Sexuality is a nonprofit ministry that produces video-based resources which promote a biblical view of sex and gender.
According to Fox News, the company filed a federal lawsuit in February against Asana, alleging that it had denied them access to a 50% discount typically offered to other non-profit organisations, because they were a religious body.
According to the complaint, Asana’s policy at the time barred discounts to nonprofits that “exist to solely propagate a belief in a specific faith.”
Christian legal advocacy firm Alliance Defending Freedom (ADF) who represented Holy Sexuality, argued the policy violated California’s Civil Rights Act, which protects against discrimination based on religion.
Asana agreed to settle the case, have provided the discount to Holy Sexuality and also revised its policy removing the exclusion from other religious organisations.
ADF confirmed that the lawsuit was dropped following the policy reversal.
"Christians and other people of faith aren’t second-class citizens in California," said ADF lawyer Mathew Hoffmann.
In a statement Asana - which serves over 15,000 nonprofit organizations - said:“Going forward, we will provide the discount to any qualifying non-profit organisation with 501(c)(3) designation, as determined by the IRS. Holy Sexuality, a customer since August 2024, will now benefit from the non-profit rate."
Holy Sexuality founder Christopher Yuan said: “Equal treatment is the bedrock of our society. We are grateful for this victory and hope it serves to remind other companies that California law protects all religions from discrimination.”
The case comes amid increased scrutiny of tech companies’ treatment of religious organisations amid extra scrutiny from the Trump administration.
